1. The agreement
These terms are an agreement between you and Transcend Code, which operates Stitchable ("we", "us"). By creating an account or using Stitchable you accept them. If you use Stitchable for a business or another organization, you accept them on its behalf and confirm you are allowed to.
2. What Stitchable does
Stitchable lets you build websites from ready-made sections, publish them at an address on stitchable.app, and collect form replies, such as RSVPs, in a Google Sheet. We may improve, change or remove features over time. If a change takes away something important you pay for, we will tell you in advance.
3. Accounts and organizations
- You must be at least 16 years old and give accurate account details.
- Keep your sign-in secure. You are responsible for what happens in your account.
- Sites and plans belong to an organization. Its admins decide who is a member and manage the plan. Members can edit and publish its sites.
4. Plans, payment and cancelling
You can build and preview sites without a plan. Publishing a site needs a paid plan. Plans, prices and what they include are shown on our pricing page.
- Plans are billed in advance, monthly or yearly, in US dollars, and renew automatically until you cancel. Payments are handled by Clerk Billing and Stripe.
- You can cancel at any time in your organization settings. Your plan then runs until the end of the period you paid for and does not renew. We do not refund partial periods, unless the law requires it.
- If you are a consumer in the European Union, you have a 14-day right of withdrawal. Because Stitchable starts as soon as you subscribe, withdrawing within those 14 days means you pay for the days you used and we refund the rest.
- We may change prices. You will hear from us at least 30 days before a new price applies to you, and you can cancel before it does.
- If a plan ends or is downgraded, sites that are already live stay online, but you cannot publish changes the plan no longer allows.
5. Your content
You keep all rights to the text, images and other content you add. You give us permission to store, copy, adapt (for example, resize images) and show it, only as needed to run Stitchable and publish your sites.
You confirm you have the rights to everything you upload and publish, including photos of other people.
6. Acceptable use
Do not use Stitchable to:
- break the law or infringe anyone's rights;
- impersonate a person or organization, or create phishing or other deceptive pages that collect passwords or payment details;
- publish hateful, harassing, violent or sexually explicit content involving minors;
- distribute malware or send spam;
- overload, probe or try to break into Stitchable or other people's sites.
We may remove content, take a site offline or reclaim a site address that breaks these rules. Where we reasonably can, we will tell you first and explain why.
7. Your visitors' data
When your site collects replies from visitors, you decide what to ask and you are responsible for that data, including telling visitors how you use it. We process it only on your behalf and on your instructions, to deliver it to your Google Sheet, as described in our Privacy Policy.
Do not use forms to collect passwords, payment card details or sensitive data such as health information.
8. Google Sheets
Form replies are stored in a spreadsheet in your own Google account, so Google's terms also apply to it. If you delete the sheet or a form's tab, or remove Stitchable's access, new replies cannot be saved until you reconnect. We are not responsible for data you delete or change in your Google account.
9. Site addresses
Addresses on stitchable.app, such as your-name.stitchable.app, remain ours. We let you use one for as long as your site exists and follows these terms. Some words and offensive addresses cannot be used.
10. Availability and backups
We work to keep Stitchable and your published sites online, but we cannot promise that they will never be interrupted, for example during maintenance or provider outages. Keep your own copies of content that matters to you, such as original photos.
11. Liability
Stitchable is provided "as is". To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profit, lost data or lost business. Our total liability for any claim is limited to the amount you paid us in the 12 months before it arose.
These limits do not apply to damage caused by our intent or gross negligence, or to any liability that cannot be limited by law, including your rights as a consumer.
12. Ending the agreement
You can stop using Stitchable and delete your sites and account at any time. We may suspend or end your access if you seriously or repeatedly break these terms, or if the law requires it. Unless that would be unlawful or put others at risk, we will warn you first and give you the chance to fix the problem.
13. Changes to these terms
We may update these terms. For important changes we will email you at least 30 days before they take effect. If you keep using Stitchable after that, the new terms apply; if you disagree, you can cancel before they do.
14. Governing law
Dutch law applies to these terms. Disputes go to the competent court in Amsterdam. If you are a consumer, you keep the protection of the mandatory laws of the country where you live and can also go to your local court. Questions or complaints? Email support@stitchable.app first; we would rather sort it out together.
